Belgium submits declaration to take part in Gaza genocide case
The court confirmed that Belgium filed its declaration on Dec. 23, basing its request on Article 63 of the ICJ Statute.
Under Article 63, any state that is a party to an international convention being interpreted in proceedings before the court is entitled to intervene in the case.
Belgium stated that its participation centers on Articles I through VI of the Genocide Convention, placing particular emphasis on Article II and, more specifically, on how the requirement of "specific intent" should be interpreted in determining genocidal intent.
In line with Article 83 of the Rules of Court, the ICJ has asked both South Africa and Israel to submit written comments addressing Belgium’s request to intervene.
South Africa initiated the proceedings on Dec. 29, 2023, alleging that Israel failed to meet its obligations under the Genocide Convention in relation to its actions in Gaza. Since the case was filed, the court has issued multiple provisional measures directing Israel to take steps aimed at preventing acts of genocide.
The ICJ, headquartered in The Hague, serves as the United Nations’ principal judicial body and is responsible for resolving legal disputes between states.
